Petfiliate Terms of Use

1. Partners are also covered by the Master Partner Agreement

If you apply to or join the Petfiliate network as a publisher, creator or media partner, the Petfiliate Master Partner Agreement governs your participation, tracking, commissions and payments. If these Terms conflict with the Master Partner Agreement, the Master Partner Agreement applies. Brands that work with us directly may have a separate written agreement, which applies to them in the same way.

2. Using the Site

You may use the Site for lawful purposes only. You agree not to:

• break any law, or infringe anyone’s intellectual property, privacy or other rights;
• submit false or misleading information, including in a Partner application or contact form;
• access or try to access accounts, systems or data you are not authorized to access;
• scrape, crawl or copy the Site or its data by automated means, except for standard search engine indexing;
• upload viruses or malicious code, or interfere with the Site’s operation or security;
• use the Site to send spam or unsolicited messages; or
• use the Site to build or support a competing service.

We may suspend or block access to the Site for anyone who breaks these Terms.

3. Accounts

Some parts of the Site require an account. You must be at least 18 years old to create one. You are responsible for keeping your login details confidential and for all activity in your account. Tell us right away at partners@petfiliate.com if you think your account has been used without permission.

4. Affiliate disclosure

Petfiliate is an affiliate marketing network. We and our Partners earn commissions when people buy from pet brands through our tracking links. Some content on the Site, and much of our Partners’ content, contains affiliate links. We may earn a commission if you click a link and make a purchase, at no extra cost to you. Brands set their own prices, product information and policies, and are responsible for their products, orders, shipping, returns and customer service.

5. Content on the Site

Content on the Site, including articles, case studies, media kits, rate information and statistics, is for general information only. It is not legal, tax, financial or veterinary advice. Performance figures and examples describe past results and are not a promise of future earnings. We try to keep the Site accurate and current, but information may change without notice.

6. Intellectual property

The Site and its content, including text, graphics, logos, the Petfiliate name, designs and software, are owned by Petfiliate or its licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own personal or internal business use. You may not copy, modify, republish or distribute Site content, or use our name or logos, without our written permission. Brand names and logos shown on the Site belong to their owners and appear for identification only; their appearance does not mean the Brand endorses Petfiliate unless we say so.

7. Your submissions

If you send us feedback, ideas or suggestions, we may use them without restriction or payment to you. If you submit content to us, such as a Partner profile, you confirm you have the right to share it and you give us a non-exclusive licence to use it to operate and promote the Petfiliate network.

8. Privacy and cookies

Our Privacy Policy explains how we collect and use personal information, and our Cookie Policy explains how we use cookies and tracking technologies, including affiliate tracking. Both form part of these Terms.

9. Third-party sites

The Site links to Brand websites and other sites we do not control. We are not responsible for their content, products, services or policies. Your dealings with any Brand, including purchases, are solely between you and that Brand.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PETFILIATE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED CA$100. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. For Partners, the liability terms of the Master Partner Agreement apply to claims about the Petfiliate network.

12. Indemnity

You will indemnify and hold harmless Petfiliate, P51 Media Ventures Ltd. and their directors, officers, employees and contractors from any third-party claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

13. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia sitting in Vancouver have exclusive jurisdiction over any dispute about these Terms or the Site, except where consumer protection law where you live gives you the right to bring a claim in your local courts.

14. Changes

We may update these Terms by posting a new version on this page with a new effective date. Your continued use of the Site after that date means you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. You may not assign your rights under these Terms. These Terms, together with the Privacy Policy, Cookie Policy and, for Partners, the Master Partner Agreement, are the entire agreement between you and us about the Site.
